Hare used his thesis of universalizability to generate specific normative results and a defense of utilitarianism. To accomplish the latter task, he enjoined that one consider oneself in various roles in a given situation, and that the concluding judgment must be one that is affirmable in any of the various roles. I argue from a consideration of Hare's multilateral case (judge and thief) that the thesis by itself cannot enable one to reach the conclusion Hare intends. I argue that Hare's arguments require additional principles or premises to reach their desired conclusion. I knew I was in for trouble, that the going would be rough, when I removed the wrapper from the “Race,” Writing, and Difference issue of Critical Inquiry and observed the word “race” in quotation marks. Something deep was clearly brewing. And any doubts were quickly removed when I turned to the opening remarks of Henry Louis Gates, Jr. “Who,” he asked me, “has seen a black or a red person, a white yellow, or brown?” . There was a (...) question that spelled trouble, a glove in the face if I ever saw one. Here I was, crude, unregenerate, lacking the hypersensitivity that prevents someone like Gates from making such infra dig distinctions; here I was, daring to use words without quotation marks, actually believing that I referred to something identifiable when I spoke of black people, Americans, musicians, and whatnot, and being told that it was all just my own narcissistic and preemptive fantasy. Here I was, faced with the impossible choice of keeping permanently quiet or of perpetuating ruthless violence—of denying the individuality of all of God’s creation—not only by referring to knives, cats, my brother, or Indians, but simply by referring at all. But why, I wondered, was only the word “race” in quotation marks? Why not every single word in the entire issue of Critical Inquiry? For to refer, it seems, is to colonize, to take things over for one’s own brutal use, to turn everything else into a mere Other. There was Gates engaging in the academic’s favorite pastime, épater les bourgeois, and here was I, a hopeless bourgeois, just asking for a put-down. Sherwin-White indeed criticised the envoys severely, especially Scipio; they were culpably blind to the (...) new menace of Parthia, which was steadily dismembering the Seleucid Empire east of the Euphrates. This is fair criticism only on the 140/39 b.c. dating. Did Scipio and his colleagues fail to see what is patent to us today? It is time to reexamine rigorously the underlying assumption. In Acad. prior. 2.5 Cicero defends a Roman noble's love of Greek learning in the following terms: ego autem cum Graecas litteras M. Catonem in senectute didicisse acceperim, P. autem Africani historiae loquantur in legatione illa nobili, quam ante censuram obiit, Panaetium unum omnino comitem fuisse, nec litterarum Graecarum nee philosophiae iam ullum auctorem requiro. The date of the embassy must be 144/3 b.c., if we follow the logic of this passage. Scipio was censor with L. Meslin and Harold T. Shapiro On 3 October 2001, Executive Order 12975 expired, and with it so too did the National Bioethics Advisory Commission (NBAC). Established by President Bill Clinton in 1995, NBAC was the fifth national committee since 1974 created to advise the U.S. (...) government on bioethics policy. In the long political tradition in this country that national bioethics policy advice should use temporary rather than permanent bodies, NBAC followed in the footsteps of the National Commission for the Protection of Human Subjects of Biomedical and Behavioral Research (1974-78); the President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Research (1980-83); the Ethics Advisory Board (1978-80); and the Biomedical Ethics Advisory Committee (1988-89). Arguably, other distinguished panels could lay claim to recognition as a "national bioethics committee" including the Advisory Committee on Human Radiation Experiments (ACHRE) (1994-95); the Fetal Tissue Transplantation Research Panel (1988); the Human Embryo Research Panel (1994); and the National Institutes of Health (NIH) Recombinant DNA Advisory Committee (RAC), which continues to function.These committees and commissions form a kind of a continuum, albeit occasionally interrupted by periods during which no such bodies existed. Each arose from a particular confluence of events and circumstances. NBAC was no different; its history can be traced both to a series of discussions within the White House Office of Science and Technology Policy beginning in 1993 (NBAC 1998a, p. 3), and to a specific recommendation from ACHRE that called for a national committee to address ethical issues in human subjects research (ACHRE 1995, p. 817). Nbac's Impact In his useful comparison of the accomplishments of the National Commission and the President's Commission, Brad Gray concluded that seven lessons were learned, the sixth of which was that "nothing substitutes for having a perceptible impact on either policy or practice" (Gray 1995, p. 304). Assessing NBAC's [End Page 95] impact on "policy or practice" is difficult, particularly given the fact that it so recently completed its work. More time may be needed before a full assessment can be undertaken of the impact of its six reports (and their total of 120 recommendations). Instead, in this essay we offer some reflections on NBAC's initial impact, using some specific examples of how bioethics gets done Inside the Beltway. Eliciting Reaction If immediate reaction by the White House is any measure of impact, then Cloning Human Beings (NBAC 1997) had a significant one. The day after he received this report in a Rose Garden ceremony, President Clinton submitted a bill to Congress that would have extended the moratorium on federal funding to create a child using somatic cell nuclear transfer. This bill never passed, nor has any other bill emerged that has enjoyed the support of the House and the Senate. Five states have enacted legislation to date, but these vary in their permissibility from bans on all forms of cloning to bans similar to the one proposed by NBAC, which recommended a time-limited prohibition only on somatic cell transfer to create a child (reproductive cloning).If the Cloning report elicited speedy action from the White House, this paled in comparison to the reaction that led to and, in turn, was created by Ethical Issues in Human Stem Cell Research (NBAC 1999a). Those who believe that government moves slowly need only be reminded of the events of 8-14 November 1998 (and, as we shall mention below, the further events of 14 July 1999). In recent years new discourses have emerged to inform philosophy and pedagogy in early childhood. These range from various postfoundational perspectives to objectivist accounts such as neuroscience in relation to brain development. Given the variety of competing narratives, the field is complex and multifaceted with potential to revision early childhood pedagogy through varied paradigms and philosophical orientations. This special issue sought scholarship on a range of philosophical perspectives about early childhood education, particularly those related to issues of pedagogy. In this (...) article, we develop an argument for philosophically informed pedagogy to balance some of the psychological and empirical approaches that dominate the field. Based on the provocations of the seven articles that comprise this issue, we argue for greater attention to subjective and even mysterious approaches to learning that call for ontological orientations to pedagogy as a relationship rather than a response or an intervention. With the growth of precision medicine research on health data and biospecimens, research institutions will need to build and maintain long-term, trusting relationships with patient-participants. While trust is important for all research relationships, the longitudinal nature of precision medicine research raises particular challenges for facilitating trust when the specifics of future studies are unknown. Based on focus groups with racially and ethnically diverse patients, we describe several factors that influence patient trust and potential institutional approaches to building trustworthiness. Drawing on (...) these findings, we suggest several considerations for research institutions seeking to cultivate long-term, trusting relationships with patients: Address the role of history and experience on trust, engage concerns about potential group harm, address cultural values and communication barriers, and integrate patient values and expectations into oversight and governance structures. The phrase military ethics is sometimes regarded as a contradiction in terms. To some, the idea of ethics seems out of touch with modern realities and sensibilities. "How can an external moral standard dictate one's actions?" some might ask. Ethics can therefore bring up memories of bygone eras that seem irrelevant. Coupled with the qualifier military, ethics can seem even more puzzling. Ethics is not merely a concern for past eras, but is increasingly relevant in an age of rapid technological (...) and societal development. From its beginning, our nation's military leaders have viewed ethics as imperative to the task of warfighting. This is a refrain echoed by contributions to this book who address a range of issues concerning political actors, technological capabilities, and societal shifts of the past and the present. And in commemorating the centenary of World War I, it is appropriate to consider the ethics of warfare. This book helpfully relates lessons from the past to the major ethical issues of modern warfare. RationaleSurrogates of critically ill patients often have inaccurate expectations about prognosis. Yet there is little research on how intensive care unit clinicians should discuss prognosis, and existing expert opinion-based recommendations give only general guidance that has not been validated with surrogate decision makers.ObjectiveTo determine the perspectives of key stakeholders regarding how prognostic information should be conveyed in critical illness.MethodsThis was a multicenter study at three academic medical centers in California, Pennsylvania, and Washington. One hundred eighteen key stakeholders completed in-depth semistructured (...) interviews. Participants included 47 surrogates of adult patients with acute respiratory distress syndrome; 45 clinicians working in study ICUs, including physicians, nurses, social workers, and spiritual care providers; and 26 experts in health communication, decision science, ethics, family-centered care, geriatrics, healthcare disparities, palliative care, psychology, psychiatry, and critical care.Measurements and main resultsThere was broad support among surrogates for existing expert recommendations, including truthful prognostic disclosure, emotional support, tailoring the disclosure strategy to each family's needs, and checking for understanding. In addition, stakeholders offered suggestions that add specificity to existing recommendations, including: In addition to conveying prognostic estimates, clinicians should help families "see the prognosis for themselves" by showing families radiographic images and explaining the clinical significance of physical manifestations of severe disease at the bedside. Many physicians did not support using numeric estimates to convey prognosis to families, whereas many surrogates, clinicians from other disciplines, and experts believed numbers could be helpful. Clinicians should conceptualize prognostic communication as an iterative process that begins with a preliminary mention of the possibility of death early in the ICU stay and becomes more detailed as the clinical situation develops. Although prognostic information should be initially disclosed by physicians, other members of the multidisciplinary team-nurses, social workers, and spiritual care providers-should be given explicit role responsibilities to reinforce physicians' prognostications and help families process a poor prognosis emotionally.ConclusionsFamily members, clinicians, and experts identified specific communication behaviors that clinicians should use to discuss prognosis in the critical care setting. These findings extend existing opinion-based recommendations and should guide interventions to improve communication about prognosis in ICUs. (shrink)

This paper investigates the key drivers behind the origins of value-for-money (VFM) audit in Canada and the aims, intents, and logics ascribed by the original proponents. Drawing on insights from governmentality and New Public Management, the paper utilizes analysis methods adapted from case study research to review a wide range of primary documentation (e.g., Hansards from the Public Accounts Committee, House of Commons debates, the so-called Wilson report and the FMCS study) and secondary documentation (newspaper articles, Office of the Auditor (...) General internal publications, journal articles). Major findings indicate a rise of a management consulting culture within the Auditor General’s office following the appointment of James Johnson Macdonell. VFM legislation effectively operationalized practices drawn from management consulting expertise by invitation of the consultant. It was offered as an answer to the growing scope and size of government, which had become problematized by the Auditor General in terms of parliament losing control over the public purse. The Auditor General’s invocation of financial crisis led to a substantial broadening of mandate and increase in resources for that office. (shrink)
